WHAT IS A NOTARY PUBLIC?
A Notary Public is an officer of the law and an internationally recognized public office. Licensed by Alberta Justice and the Solicitor General under the Notaries and Commissioners Act, Notary Publics are able to legally certify and attest to the validity of notarized documents and the execution of a document.
A signature and seal from a Notary Public make them valid as proof to judicial and other public authorities in Calgary, Alberta, and Canada. In Alberta, a Notary Public seal must include the name of the Notary Public, the words ‘Notary Public’, and the words ‘Province of Alberta’.
WHEN DO I NEED A NOTARY PUBLIC?
For a simple taking of an oath, if the oath is made in Alberta and only used in Alberta, only a Commissioner of Oaths is needed. For use outside of Alberta, you will need an oath notarized.

- Complete as much of your documents as possible before your appointment.
- Do not sign any documents prior to your appointment.
- Bring original documents and all relevant supporting documents.
- Make sure to bring two pieces of government-issued identification with you to confirm your identity, including one piece of government-issued photo identification.
- If you require certified copies of documents, you must bring in the original document with you for comparison.
- All parties required to sign the document must appear in person.

A Notary Public or a Commissioner of Oaths has the power to notarize documents in Alberta. However, a Commissioner of Oaths cannot endorse documents to be used outside Alberta.
A Commissioner of Oaths can administer oaths and take, receive, and attest to affidavits, affirmations, and declarations. While a Notary Public can act as a Commissioner of Oaths, a Commissioner of Oaths cannot act as a Notary Public.
In order to be valid, each document the Commissioner of Oaths verifies must include their name, the words “A Commissioner for Oaths in and for Alberta”, and the expiry date of their appointment (if appointed).
No. A Notary Public cannot provide independent legal advice. However, a lawyer can give legal advice and act as a Notary Public. If you are uncertain about the requirements of a particular document, it is best to consult a lawyer for your notarization needs.
Notary Publics are appointed under the Notaries and Commissioners Act. All practicing lawyers are Notary Publics. Certain other people can also be appointed as a Notary Public because of their office or status, including members of the Alberta Legislature, members of the House of Commons, and Canadian Senators.
A Statutory Declaration is a written statement of facts that a person, the ‘declarant’ declares to be true. A Statutory Declaration can be witnessed by a Notary Public.
